Acceptable Use Policy
What may and may not be sold through DorskoPay, and what happens when this policy is breached.
The short version
- check DorskoPay's initial production scope is software and digital software products, delivered digitally.
- check Everything on the prohibited list in clause 4 is unavailable. Everything on the restricted list in clause 5 requires written approval before it goes live.
- check Subscription conduct is part of acceptable use: hidden renewals, unclear trials and obstructed cancellation are breaches.
- check DorskoPay may treat a category as restricted even where it is not listed, where an acquiring partner, a card scheme rule or a risk assessment requires it.
1. Who this platform is built for
DorskoPay is being built as an authorised reseller and Merchant of Record platform for software and digital products. Because DorskoPay becomes the seller of record on every transaction, it takes on the legal, tax and dispute responsibility for what is sold. That is the reason this policy is narrower than a general payment gateway's: we are not passing a transaction through, we are selling the product.
Our initial production scope is deliberately narrow: software businesses whose product is delivered digitally, whose pricing model can be described to an acquiring partner in a sentence, and whose delivery is verifiable.
2. Generally supported
Subject to verification and product approval under the Supplier Agreement, the following are within our intended scope:
- SaaS — hosted software sold as a subscription or a one-off licence.
- Software subscriptions — recurring access to a software product.
- AI software — AI-powered applications, APIs and tooling sold to businesses or consumers.
- Developer tools — SDKs, libraries, CLI tools, hosting and infrastructure tooling.
- Business and productivity software — CRM, accounting, project management, analytics and similar.
- Downloadable software — desktop and mobile applications delivered by download.
- Plugins and extensions — add-ons for a host platform, CMS, IDE or browser.
- Software licences — perpetual or term licences, seat-based or usage-based.
- API and usage-based access — metered access to a documented API.
- Other legitimate digital software products delivered digitally and supported by the supplier.
Being in this list makes a product eligible for review. It does not make it approved: every product goes through product approval, and approval can be declined or made conditional.
3. Requirements that apply to everything sold here
Regardless of category, a product may only be sold through DorskoPay where:
- the supplier owns or is validly licensed to sell it;
- the description, feature claims, availability statements and system requirements are accurate and not misleading;
- the price, the currency, and for a subscription the renewal price and interval, are stated clearly before purchase;
- delivery is digital, and either immediate or within a timeframe stated on the product;
- the supplier provides genuine product support;
- the product and its sale comply with applicable law in the markets where it is offered;
- the supplier holds any licence, registration or permission the product requires.
4. Prohibited
The following may not be sold through DorskoPay in any circumstances:
- Illegal products and services
- Anything unlawful in the jurisdiction of the supplier, of DorskoPay, or of the buyer.
- Fraud and deception
- Products or schemes designed to deceive buyers, fake or non-existent software, services that misrepresent what the buyer will receive, and any offering whose commercial purpose is to obtain money without providing what was promised.
- Malware and unwanted software
- Viruses, ransomware, trojans, cryptominers installed without consent, adware, and software that installs or persists without the user's informed consent.
- Credential theft and surveillance tooling
- Phishing kits, credential harvesters, keyloggers, stalkerware, spyware, and covert monitoring software marketed for use on a person without their knowledge.
- Attack and intrusion tooling
- Tooling marketed for unauthorised access, denial-of-service, botnet operation, or the exploitation of systems the buyer does not own or have permission to test.
- Copyright-infringing material
- Pirated software, cracked applications, licence-key generators, unauthorised copies, and tools whose primary purpose is circumventing licensing or DRM.
- Counterfeit digital goods
- Counterfeit software, spoofed brands, and products passed off as another company's.
- Stolen digital goods, accounts or keys
- Resale of stolen or improperly obtained accounts, licence keys, subscriptions or credentials.
- Unauthorised resale
- Reselling another company's software without the rights to do so.
- Money laundering and terrorist financing
- Any use of the platform to launder proceeds of crime or to finance terrorism, including transaction laundering — processing another business's transactions through your account.
- Sanctions evasion
- Any transaction structured to evade applicable sanctions, or with a sanctioned person or in a sanctioned territory.
- Unlicensed financial services
- Deposit taking, lending, money transmission, payment services, insurance, or investment services offered without the required authorisation.
- Investment schemes
- Trading signals, guaranteed-return products, binary options, and investment products or advice offered without the required authorisation.
- Pyramid, MLM and get-rich-quick schemes
- Pyramid selling, multi-level marketing, chain schemes, and business-opportunity products premised on recruitment or unrealistic earnings claims.
- Weapons
- Firearms, ammunition, explosives, weapon components, and software whose function is the manufacture of weapons.
- Drugs and controlled substances
- Controlled substances, precursors, and products marketed for their evasion of drug testing.
- Adult and pornographic services
- Pornography, adult content platforms, escort and sexual services.
- High-risk subscription traps
- Negative-option billing, undisclosed continuity programmes, and subscription flows designed so that a buyer is charged without having understood that they were subscribing.
- Misleading free trials
- Trials that do not state the post-trial price, do not state the conversion date, or make cancellation before conversion difficult.
5. Restricted — written approval required
The following are not available by default. They may be considered only with explicit written approval from DorskoPay, supporting licensing evidence where relevant, and an acquiring partner willing to support the category. Treat everything here as unavailable unless we have confirmed otherwise in writing.
- Crypto asset services — exchange, custody, wallets, mining services, token sales, and software whose primary function is crypto asset dealing.
- Gambling and gaming for money — betting, casino, lottery, skill gaming for prizes, and loot mechanics involving real-money value.
- Regulated goods and services — pharmaceuticals, medical devices, supplements with health claims, tobacco and nicotine, alcohol, and anything requiring a sector licence.
- Donations and charitable fundraising — including charity software that collects donations through the checkout.
- Travel and ticketing — flights, accommodation, tours and event ticketing, where payment is taken materially in advance of delivery.
- Marketplaces and creator platforms — where the account would be used to collect for multiple independent third-party sellers.
- Physical goods — anything shipped, including hardware bundled with software.
- Financial software with a regulated component — where the product itself performs a regulated activity rather than supporting one.
- Education and coaching with an earnings claim — courses or coaching marketed on income outcomes.
- Gaming, virtual currency and in-game items — including secondary-market trading of virtual items.
These categories are restricted mainly because they carry elevated dispute, delivery-risk or regulatory exposure that DorskoPay would carry directly as seller of record — not because they are disreputable. Several are ordinary businesses that simply need a different underwriting conversation.
6. Not yet in scope
Marketplaces, creator platforms and gaming are not part of our initial production scope. They are categories we may support in a later phase, once the core software use case is in production and the relevant acquiring-partner and risk requirements are settled.
They are not available today, and a sandbox account that demonstrates one of these models does not indicate that it will be approved.
7. Subscription and trial conduct
Because DorskoPay is the seller of record on the transaction, how a subscription is sold is part of acceptable use, not merely a matter of taste. The following are requirements:
- Recurring charges must be clearly disclosed before purchase, not in a footnote or a linked document.
- The renewal price and interval must be stated at the point of purchase.
- A free trial must state its length, the price that applies when it ends, and the date of the first charge.
- Cancellation must be available online, without obstruction, where the subscription was entered into online.
- A retention flow may make an offer; it may not require a phone call, impose a waiting period, hide the cancellation control, or require a reason before cancelling.
- A price increase on an ongoing subscription must be notified in advance and must never apply retrospectively.
Flows designed to make cancellation difficult, or to obscure that a purchase is recurring, are a breach of this policy and are grounds for immediate suspension. The corresponding buyer-side commitments are in the Subscription Policy.
8. Buyer conduct
This policy also applies to buyers. A DorskoPay checkout must not be used to make an unlawful payment, to test stolen payment credentials, to obtain a product by deception, or to circumvent a restriction applied to an account.
Raising a chargeback on a charge known to be valid, in order to obtain a product without paying for it, is a breach of the Buyer Terms as well as of this policy.
9. Enforcement
We may request information about any product listed on any account, at any time, and may review a supplier's public website and product presentation as part of ongoing monitoring.
Where we reasonably believe this policy has been breached we may: suspend an individual product; stop new transactions; withhold settlement or payouts; apply a reserve; suspend the account; or terminate the relationship. We may also act on the instruction of an acquiring partner, payment partner or card scheme, and may be prohibited by law from explaining why.
Where a breach is remediable and was not deliberate, we will normally say what would fix it and give an opportunity to fix it. Where it involves fraud, financial crime, malware or illegal content, we will not.
The corresponding contractual rights are in clauses 26 and 27 of the Supplier Agreement.
10. Categories not listed here
This clause exists because card scheme and acquirer requirements change, and because novel products appear faster than any list can be maintained. It is not a licence to act arbitrarily: where we restrict a category not listed here, we will say so and explain the basis.
This policy is reviewed at least annually, and whenever an acquiring partner requirement changes what we can support.
11. Questions and appeals
If you are unsure whether your product is in scope, ask before you build the integration. Write to support@dorskopay.com with a description of the product, how it is delivered, how it is priced and who buys it. An early answer costs you an email; a late one costs you an integration.
If a product or account has been restricted and you think the decision is wrong, ask for it to be reviewed under the Complaints Policy. A review is carried out by someone other than the person who made the original decision.
